1. Introduction
IPTV Ireland ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.
We also reserve the right to remove or disable access to content that we believe in good faith infringes the copyrights of others.
2. DMCA Notice and Takedown Procedure
If you believe that content available through our Service infringes your copyright, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):
2.1 Required Information
A valid DMCA takedown notice must include:
- Physical or Electronic Signature: A signature (physical or electronic) of the copyright owner or a person authorized to act on their behalf.
- Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URLs, channel names, content titles).
- Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Submitting a DMCA Takedown Notice
DMCA takedown notices should be sent to our designated Copyright Agent:
Copyright Agent: IPTV Ireland DMCA Department
Email: support@irelandiptv.net
Subject Line: DMCA Takedown Request
Response Time: We will respond to valid DMCA notices within 48 hours of receipt.
Important: Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.
4. Counter-Notification Procedure
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. A valid counter-notification must include:
4.1 Required Information
- Physical or Electronic Signature: Your physical or electronic signature.
- Identification of Removed Content: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Contact Information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
4.2 Submitting a Counter-Notification
Counter-notifications should be sent to the same Copyright Agent address listed above. Upon receipt of a valid counter-notification, we will forward it to the original complaining party. The original complaining party will then have 10 business days to file a court action seeking a court order to restrain you from engaging in infringing activity. If no such action is filed, we may restore the removed content.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Service Provider Status
IPTV Ireland operates as a service provider that transmits, routes, and provides connections for digital online communications. We do not control, monitor, or edit the content transmitted through our Service. Content is provided by third-party sources, and we act as an intermediary in the transmission of such content.
We comply with the safe harbor provisions of the DMCA and are not liable for copyright infringement by users or third parties, provided we respond appropriately to valid DMCA notices.
7. Content Removal and Restoration
7.1 Removal Process
Upon receipt of a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing content
- Notify the user who posted the content (if applicable)
- Provide the user with a copy of the DMCA notice
- Inform the user of their right to file a counter-notification
7.2 Restoration Process
If a valid counter-notification is received and no court action is filed within 10 business days, we may restore the removed content. We are not obligated to restore content if we believe it infringes copyright or violates our Terms of Service.
8. False or Fraudulent Notices
We take false or fraudulent DMCA notices seriously. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents:
- That material or activity is infringing, or
- That material or activity was removed or disabled by mistake or misidentification
May be liable for damages, including costs and attorneys' fees. We reserve the right to pursue legal action against individuals who submit false or fraudulent DMCA notices.
9. Third-Party Content
Our Service may include content provided by third parties, including live TV channels, movies, and TV series. We do not claim ownership of this content and act as an intermediary service provider. If you believe third-party content available through our Service infringes your copyright, please follow the DMCA takedown procedure outlined above.
10. Cooperation with Law Enforcement
We will cooperate with law enforcement and copyright holders in investigating and prosecuting copyright infringement. We may disclose user information and content in response to valid legal requests, court orders, or subpoenas.
